These Terms of Use ("Terms") constitute a legally binding agreement between you and Eventa, a Delaware corporation ("Eventa," "we," "us," or "our"), governing your access to and use of our platform, including our website, mobile application, and related services (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Acceptance of Terms

By accessing or using Eventa's Services:

• You represent that you are at least 18 years old or that you have obtained parental or guardian consent.
• You affirm that you have the authority to enter into this agreement on behalf of yourself or any entity you represent.
• You confirm that your use of the Services complies with all applicable laws and regulations in your jurisdiction.

Our Services

Eventa provides a platform that enables event organizers to create events, sell tickets, manage RSVPs, and facilitate event-related communications. Eventa acts solely as an intermediary between Organizers and Users:

• Organizer Responsibility: Organizers are solely responsible for their events' content, execution, ticketing policies, and compliance with applicable laws.
• No Guarantees: Eventa does not guarantee the availability, quality, safety, legality, or accuracy of any events listed on our platform.

Ticket Purchases and RSVPs

• Payments are processed by third-party providers (e.g., Stripe). By completing a transaction, you agree to be bound by their terms.
• Refunds are governed by each Organizer's refund policy unless otherwise stated at the time of purchase.
• Tickets purchased through Eventa may not be resold or transferred unless explicitly permitted by the Organizer.

Fees and Taxes

• Eventa charges service fees for ticket sales and other transactions. These fees will be disclosed at checkout.
• You are responsible for paying any applicable taxes associated with your purchases on our platform.

Service fees charged by Eventa are non-refundable unless otherwise required by law.

Prohibited Activities

You agree not to engage in any activity that:

• Violates any applicable law or regulation.
• Involves fraudulent practices (e.g., reselling tickets without authorization).
• Introduces malware or harmful code into our platform.
• Interferes with the functionality of our Services.
• Misrepresents your identity or affiliation with any person or organization.

Limitation of Liability

To the fullest extent permitted by law:

• Eventa is not liable for indirect damages (e.g., loss of profits).
• Our total liability will not exceed fees paid by you within six months prior to the claim.

Dispute Resolution

For U.S.-based users: Disputes will be resolved through binding arbitration in New York under American Arbitration Association rules unless otherwise prohibited by law.
For international users: Local laws may apply where required by mandatory consumer protection rules.

Governing Law

These Terms are governed by New York law (for U.S.-based users) and Canadian provincial laws (for Canadian users), without regard to conflict-of-law principles. International users may be subject to local consumer protection laws where applicable.
